Today Union meeting with DG Posts  regarding GDS Pay Committee

Today meeting held in Dak Bhavan at 11 Am.

Admin side: DG posts,Member ( p), DDG ( Estt),DDG( SR& Legal) ADG ( Estt),ADG( GDS),and other officers.

Union side: All three GDS General Secretaries and GS Group ' C ,Fnpo.

Detailed discussion held between Administration and union representatives on the basis of GDS JCA memorandum, major issues viz ,date of implementation of new scales,payment of arrears, gratuity, financial upgradation,leave etc...

Department catagarically replied that in case of implementation issues like date of implementation of new scales,arrearsformula,as already cleared by cabinet and it can not be reopened.
Regarding all other issues viz..leave, CEA,GIS, transfer , ESI facility,Sdbs,financial upgradation etc will be considered positively and orders will be issued as early as possible.

But union representatives expressed their resentment and deep concern over the date of implementation of new scales , arrears payment formula and strongly demanded to consider.

Department proposed the unions to submit a detailed note on all the issues raised in the meeting further consideration at appropriate level.

Three General Secretaries of GDS discussed over the today's meeting and decided to submit a detailed note soon.

Further decided to meet again to decide future course if program of action seriously.

(a) whether it is a fact that Government has asked all its departments and the State Governments to implement reservation in promotion for employees belonging to Scheduled Castes and Scheduled Tribes categories; 

(b) if so, the details thereof; 

(c) whether it is also a fact that the move comes following a recent verdict by the Supreme Court in this regard; and

(a) to (d): The Supreme Court in Special Leave Petition (Civil) No.30621/2011 has passed the following order on 17.5.2018:-

“It is directed that the pendency of this Special Leave Petition shall not stand in the way of Union of India taking steps for the purpose of promotion from ‘reserved to reserved’ and ‘unreserved to unreserved’ and also in the matter of promotion on merits..”.

Further, in the matter related to Special Leave Petition (Civil) No.31288/2017 connected to Special Leave to Appeal (Civil) No.28306/2017, the Supreme Court held as under on 05.06.2018:-

“Heard learned counsel for the parties, Learned ASG has referred to order dated 17.05.2018 in SLP(C) No.30621/2011. It is made clear that the Union of India is not debarred from making promotions in accordance with law, subject to further orders, pending further consideration of the matter. Tag to SLP (C) No.30621 of 2011.”

Based on interim Orders/directions of the Supreme Court dated 17.05.2018 and 05.6.2018, Department of Personnel and Training vide Office Memorandum No. 36012/11/2016- Estt.(Res-I) {Pt-II} dated 15.06.2018 requested all the Ministries/Departments of the Government of India to carry out promotions in accordance with above directions of the Supreme Court on existing seniority / select lists subject to further orders which may be passed by the Supreme Court. The State Governments were advised to take necessary action in accordance with the above-mentioned orders passed by the Supreme Court.

Extension of time limit of reservation for Scheduled Tribes

(a) the extent to which the people belonging to Scheduled Tribes, including the Meena tribe, have been benefitted, as a result of reservation of posts for them as on date;

(b) by when the benefit of reservation provided to them would come to an end; 

(c) whether Government proposes to extend the time-limit of reservation for the people of Scheduled Tribes for the next ten years;
(d) if so, the details thereof; and

(e) by when the time-limit for reservation is likely to be extended for them by Government? 

ANSWER

(a) Department of Personnel & Training, Ministry of Personnel, Public Grievances and Pensions is the nodal agency for framing policy for reservation of Scheduled Tribes. As per Department of Personnel & Training, the benefit of reservation for the Central Government posts and services is provided to the Scheduled Tribes as a composite group and not caste/sub-caste wise. The representation of Scheduled Tribes in the posts and services of the Central Government as on 01.01.2016 is 2,76,007 as against the total employee of 32,58,663, which comes to about 8.4%.

(b) to (e): Reservation to Scheduled Tribes is continuing in Direct Recruitment in all Grades. In Promotion, reservation for Scheduled Tribes is available up to entry level of Group ‘A’. No Specific time limit was fixed in DOPT’s OM dated 13.08.1997 for continuing reservation in promotion for Scheduled Tribes. However, this OM was quashed by the Hon’ble Delhi High Court on 23.08.2017 against which Special Leave Petition has been filed by Union of India in the Hon’ble Supreme Court, which is pending.

Abolition of Contributory Pension Scheme

(a) whether the attention of Government is drawn to the matter of Contributory Pension Scheme and problems being faced by the employees;
(b) if so, the details thereof; 
(c) whether a number of requests from State Governments and Government employees have been received by Government to withdraw the CPS System, the status of such requests; and 
(d) whether Government is planning to resolve the matter and abolish the CPS System in view of the problems being faced by the employees?
ANSWER
The Minister of State in the Ministry of Finance 
(a) to (d) Yes Sir. Representations have been received from various Associations of Government Employees on the problems being faced and the demand to withdraw the National Pension System (NPS). The 7th Central Pay Commission (CPC) also in its report examined the issues related to NPS and made recommendations for addressing these issues. Pursuant thereto, it was decided to constitute a Committee of Secretaries to suggest measures for streamlining NPS. The Committee has submitted its report. Due to rising and unsustainable pension bill and keeping in view of fiscal imperatives, it is not possible for the government to revert back to old pension scheme.

Govt extends deadline for filing income tax returns by a month to August 31


The Central Board of Direct Taxes (CBDT) has extended the due date for filing of Income Tax Returns from July 31, 2018, to August 31, 2018, for certain categories of taxpayers.


The Central Board of Direct Taxes (CBDT) has extended the due date for filing of Income Tax Returns to August 31, 2018, for categories of taxpayers who were to file their returns by July 31.
The decision comes days ahead of the July 31 deadline, which several groups had requested the government to push to later.
CBDT had notified the new income tax return forms for assessment year 2018-19 on April 5. Experts said the introduction of new forms was leading to delays in filing of returns.
Further, the CBDT had said non-filing of ITR before the due date from this assessment year would lead to a penalty of Rs 1,000, 5,000 and Rs 10,000, depending on when the returns were filed after the deadline. The fine for taxpayers having income under Rs 5 lakh remained at Rs 1,000.

If you are still unclear in choosing the appropriate ITR for disclosing your income earned during the previous year, here's a quick guide on the various ITR forms.
ITR 1 Sahaj:
Applicable to individuals that are an ordinary resident in India deriving income from salaries, one house property, other sources and having total income upto Rs 50 Lacs.
ITR 2:
It is applicable to any individual having total income exceeding Rs. 50 Lacs or having foreign asset/income or having more than one residential house property or income from capital gain or HUF.
ITR-3:
It is applicable to individuals and HUFs deriving income from profits and gains from business or profession along-with any income from salaries or house property or capital gains or other sources.
ITR-4 SUGAM:
It is for resident taxpayers (Individual, HUF, Firm other than LLP), who have opted for presumptive income scheme as laid down under section 44AD, 44ADA and 44AE of the Income Tax Act, 1961.
ITR-5:
This form can be used by a person being a Firm, Limited Liability Partnerships (LLP), AOP/BOI, Private discretionary trust, an Artificial juridical person referred to in section 2(31)(vii), Cooperative Society and Local authority.
ITR-6:
This form is being used by Company, other than a company claiming exemption under section 11 of the Income Tax Act. The ITR also introduces a new Schedule for Ind AS Compliant companies wherein they are required to disclose the balance sheet and P/L account in the same format as prescribed under the Companies Act, 2013
ITR-7:
Required to be filed when individuals including companies fall under section 139(4A) or 139(4B) or 139(4C) or 139(4D) or 139(4E) or 139(4F). This ITR form is basically meant for trusts claiming exemptions u/s 11 of the Act, Political party, Mutual funds, Securitization trust, and other specified assesses.

The provision of section 13(1)(d)(iii) of the Prevention of Corruption Act, 1988 as it presently exists is as follows:
“13. Criminal misconduct by a public servant.
(1) A public servant is said to commit the offence of criminal misconduct,-
…….
if he,----
……..
(iii) while holding office as a public servant, obtains for any person any valuable thing or pecuniary advantage without any public interest;…….”

The aforesaid provision does not carry the element of mens rea and thus does not confine such type of corruption to bribing of a public servant or any dishonest behavior by him. This raises apprehensions and fears in the mind of public servant which prima facie have the potential of impeding and slowing down decision making. 

The Prevention of Corruption (Amendment) Bill, 2013, for amending the Prevention of Corruption Act, 1988, was introduced in the Rajya Sabha on 19.08.2013. The Bill after having been considered by the Department related Parliamentary Standing Committee on Personnel, Public Grievances, Law and Justice, in its 69th Report and the Law Commission of India in its 254th Report, was also examined by the Select Committee of Rajya Sabha, which submitted its report on the Bill to the Rajya Sabha on 12th August, 2016. 

Recommendations made by the Select Committee in its report on the Bill were considered by the Government and official amendments were moved on the Bill as reported by the Select Committee of the Rajya Sabha.

The Bill was taken up for discussion and passed by the Rajya Sabha on 19th July, 2018 during its current 246th Session. Further, it was taken up for discussion and passed by the Lok Sabha on 24th July,2018 during its current 15th Session of the 16th Lok Sabha.
