Legal Status of GDS - GDS Committee Recommendations

Date : 17.4.2017

Legal Status of GDS - GDS Committee Recommendations

We demanded the GDS Pay Committee to remove the ceiling on the work hours and working hours i.e. Removal of Rule 3A (I) of GDS Conduct & Engagement Rules. This rule has no way concern to legal status of GDS because the Rule was framed by DoP only. These Rules have no legality.

Legal Status to GDS is completely different from removal of 5 hours cap. At present majority of GDS performing their duties beyond 5 hours. It is evidently proved through the Right to Information  Act which was already submitted to GDS Pay Committee ( up to 16 & 18 hours GDS BPM's are still working ).

After implementation of Rural ICT & India Post Payment Bank, all most all the GDS including MC/ MD will also perform their duties beyond 5 hours in all 23 Circles.By removing this ceiling of 5 hours work , they must be obsorbed as Contractual or Temporary or may be Permanent employees.

Government of India may take a decision on that matter. Before that the Department of Posts must ammend that Rule 3 A (I) of GDS Conduct & Engagement Rule and mandatorily provide 8 hours duty to all the Gramin Dak Sevaks.

It is one and only major demand of National Union.

President , NUGDS.
