Strike notice served by the JCA leaders

STRIKE NOTICE FOR 20 th  AND 21 st FEBRUARY 2013 SERVED TO THE SECRETARY DEPARTMENT OF POSTS, NEW DELHI  on 22.01.2013 by the JCA LEADERS.

Our Circle JCA meeting held at Circle office on 22.1.2013 and formed as JCA as follows and served strike notice to the CPMG.

CHARTER OF DEMANDS


PART – I
1.  Take Concrete measures to contain price rise.

2. Take Concrete measures for linkage of employment protection with the concession/incentive package offered tothe entrepreneurs,
3. Ensure Strict enforcement of all basic
labour laws without any exception or
exemption and stringent punitive
measures for violation of labour laws,
4. Universal social security cover for the
unorganized sector workers without any
restriction and creation of a National
Social Security Fund with adequate
resources in line with the recommen
dation of NCEUS and Parliamentary
Standing Committee on Labour.
5. Stoppage of disinvestment in central and
state PSUs.
6. No Contractorisation of work of
permanent/perennial nature and
payment of wages and benefits to the
contract workers at the same rate as
available to the regular workers of the
industry/ establishment
7. Amendment of Minimum Wages Act to
ensure universal coverage irrespective
of the schedules and fixation of statutory
minimum wage at not less than Rs.
10,000/-.
8. Remove all ceilings on payment and
eligibility of Bonus, Provident Fund;
Increase the quantum of gratuity.
9. Assured statutory Pension for all.
10. Ensure Compulsory registration of trade
unions within a period of 45 days and
immediate ratification of the ILO
Conventions Nos. 87 and 98.

PART – II
1. Appoint Seventh Central Pay
Commission for revision of wages of
Central Government Employees
including Gramin Dak Sewaks. Grant
merger of 50% of DA with pay for all
purposes, including GDS.
2. Stop abolition of posts and restore all
abolished posts with immediate effect.
3. Grant Civil Servant status to Gramin Dak
Sewaks and extend all benefits of
regular employees to GDS also. Enhance
GDS Bonus ceiling from 2500/- to 3500/- .
End discrimination in wages and other
service conditions.
4. Revise the wages of Casual, Part-time &
contingent employees with effect from
1.1.2006 at par with the minimum pay
scale implemented as per 6th CPC
recommendations. Regularisation of the
services of casual labourers.
5. Drop the proposal for privatization of
Postal Sector and retrograde clauses of
the National Postal Policy 2012.
6. Revision of OTA rates as per the
Arbitration award.
7. Complete the cadre restructuring and
honour the assurance given to staff side.
8. Remove arbitrary restrictions imposed
on compassionate appointments.

The 20th All India Conference started on 10.01.2013 at Acharya Nagarjuna University Auditorium. The Grand open session commenced at 1700 hours and presided by Sri Rajat.S. The stunning performance got the standing ovation from the Audience. Sri Ajaya Kumar was honoured by Sri D.Theagarajan, S/G, Sri D.Kishan Rao, G/S, and Sri Vasi Reddi Sivaji, G/S Reception committee.

EMERGENCY TREATMENT IN CGHS HOSPITALS

CGHS Hospitals – Getting treatment in emergency conditions
           Under emergency conditions, the empanelled hospitals are expected to provide treatment of CGHS beneficiaries in all available specialties…

          Private hospitals have been empanelled under CGHS only for such specialties for which they are eligible as per the terms and conditions of empanelment. However under emergency conditions, the empanelled hospitals are expected to provide treatment of CGHS beneficiaries in all available specialties.


         “Emergency” shall mean any condition or symptom resulting from any cause, arising suddenly and if not treated at the earliest opportunity would be detrimental to the health of the patient or shall jeopardize the life of the patient".

CGHS beneficiary attending hospital in emergency: In such a situation the Hospital shall intimate to BCA within 2 hours of admission and BCA shall respond in 4 hours (however treatment shall not be denied to any CGHS member and this is only an initiation of the e-workflow). Post discharge hospital would upload bills and download documents as per requirements of CGHS within 72 hours.

TREATMENT IN EMERGENCY 
In emergency the hospital shall not refuse admission or demand an advance payment from the beneficiary or his family member and shall provide credit facilities to the patient whether the patient is a serving employee or a pensioner availing CGHS facilities, on production of a valid CGHS card and the hospital shall submit the bill for reimbursement to the concerned Deptt. / Ministry / CGHS.  The refusal to provide the treatment to bonafide CGHS beneficiaries in emergency cases without valid ground would attract disqualification for continuation of empanelment.

The following ailments may be treated as emergency which is  illustrative only and not exhaustive, depending on the condition of the patient :

Acute Coronary Syndromes (Coronary Artery Bye-pass Graft / Percutaneous, Transluminal Coronary Angioplasty) including Myocardial Infarction, Unstable Angina, Ventricular Arrhythmias, Paroxysmal Supra Ventricular Tachycardia, Cardiac Temponade, Acute Left Ventricular Failure / Severe Congestive Cardiac Failure, Accelerated Hypertension, Complete Heart Block and Stoke Adam attack, Acute Aortic Dissection.

Acute Limb Ischemia, Rupture of Aneurysm, Medical and Surgical shock and peripheral circulatory failure. Cerebro-Vascular attack-Stokes, Sudden unconsciousness, Head injury, Respiratory failure, decompensated lung disease, Cerebro-Meningeal Infections, Convulsions, Acute Paralysis, Acute Visual loss.

Acute Abdomen pain.
Road Traffic Accidents / with injuries including fall. Severe
Hemorrhage due to any cause.
Acute poisoning.
Acute Renal Failure.
Acute abdomen pain in female including acute Obstetrical and Gynecological emergencies.
Electric shock. 
Any other life threatening condition.

Historic judgment on MACP by CAT Jodhpur Bench

The Hon CAT, Jodhpur, has delivered a historic judgement regarding granting of MACP. In its common order dated 22.05.2012 in OA 382/ 11. As per the Order, Promotion of a PA from Gr D/ Postman, should not be treated as promotion under MACP. Rather, MACP shall be granted based on the 10, 20, 30 years service in the PA cadre. Any promotions under LDCE shall not be brought into number of promotions under MACP.
